I filed BK-7 in Michigan in 05/2005, was discharged in 08/2005.I made my mortgage payments on time before, during and after the BK, because I want to keep my house. Attorney error the mortgage (never been reaffirmed). I’m not getting any credit for my mortgage payments on my credit report what so ever!!, to help me boost my credit and rebuild it. I tried so many times to contact Mortgage Company to fix the problem; they don’t want to cooperate no matter what.they showing on my credit report that the dept included or discharged in BK-7, and the account is closed as of 05/2005. I lost hope…Then I was advised to just walk away from the house and leave it for them to sell it, and just buy a new house with a new morgage. I hate to do that after 5 years of paying on the house. But if this is the only choice I have, will that go as a foreclosure on my credit? Or what kind of hits my credit will have as a result of this action?? And can they sue me??

Yes, they can sue you. Unfortunately, yes this will be reported to your credit after the bankruptcy. Unfortunately, an attorney is only a representative, not a responsible party. Good luck.
